2. Acceptance of terms

• Academic programs: TOEFL, IELTS, and Cambridge exam preparation courses
• Diagnostic assessments: Business English Diagnostic and Calibris proficiency analysis
• Online resources: blog articles, guides, and educational content

Results from our programs depend on individual effort, participation, and commitment. We do not guarantee specific outcomes.

4. Programs and payments

4.1 Enrollment

Enrollment in any program is confirmed only after a strategy call with our team and acceptance of the program agreement.

4.2 Pricing and payments

All prices are quoted in EUR. Payments are processed securely through Stripe. Payment terms are specified in your individual program agreement.

4.3 Cancellation and refunds

• Before program start: full refund
• Within the first 7 days: pro-rated refund for remaining sessions
• After 7 days: no refund for completed sessions

4.4 Enterprise guarantee

For enterprise clients: if agreed-upon targets are not met and all sessions have been attended, the program will be extended at no additional cost.

5. Intellectual property

5.1 Ownership

All content on this website and within our programs — including text, graphics, logos, images, course materials, assessments, and software — is the exclusive property of Achivr Educational Technologies OÜ or its licensors. The following are trademarks of Achivr Educational Technologies OÜ:

6. Diagnostic assessment terms

By completing our Business English Diagnostic, you acknowledge that:

• Your responses may be analyzed using AI-powered tools to generate proficiency assessments
• Results are indicative of your current level and do not constitute a certified qualification
• We may use anonymized, aggregated assessment data for research and service improvement
• For enterprise clients, assessment results may be shared with authorized company representatives as agreed in the program terms

7. User conduct

When using our website and services, you agree not to:

• Provide false or misleading information
• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Disrupt or interfere with the operation of our website
• Use automated tools, bots, or scripts to access or interact with our services without authorization

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to our services shall not exceed the greater of:

• The fees you paid to us in the 12 months preceding the claim, or
• EUR 100

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the availability, accuracy, or fitness for a particular purpose of our services.

Nothing in these terms excludes or limits our liability for fraud, willful misconduct, or any other liability that cannot be excluded under applicable law.

9. Third-party links and services

Our website may contain links to third-party websites and services. We are not responsible for the content, privacy practices, or availability of these external sites.

10. Governing law and jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from these terms shall be submitted to the courts of Tallinn, Estonia.

If you are a consumer in the European Union, nothing in these terms affects your rights under mandatory consumer protection laws of your country of residence.

11. Changes to these terms

These Terms and Conditions, together with our Privacy Policy and any applicable program agreements, constitute the entire agreement between you and Achivr Educational Technologies OÜ regarding the use of our website and services.
