2. Acceptance of terms

By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or services.

You must be at least 16 years of age to use our services. If you are using our services on behalf of an organization, you represent that you have the authority to bind that entity to these terms.

3. Our services

Achivr provides the following services:

  • Enterprise programs: corporate communication training and Business English coaching for teams
  • Professional programs: individual Business English coaching and professional communication training
  • Academic programs: TOEFL, IELTS, and Cambridge exam preparation courses
  • Diagnostic assessments: Business English Diagnostic and BASTION proficiency analysis
  • Online resources: blog articles, guides, and educational content

Results from our programs depend on individual effort, participation, and commitment. We do not guarantee specific outcomes.

4. Programs and payments

4.1 Enrollment

Enrollment in any program is confirmed only after a strategy call with our team and acceptance of the program agreement.

4.2 Pricing and payments

All prices are quoted in EUR. Payments are processed securely through Stripe. Payment terms are specified in your individual program agreement.

4.3 Cancellation and refunds

  • Before program start: full refund
  • Within the first 7 days: pro-rated refund for remaining sessions
  • After 7 days: no refund for completed sessions

4.4 Enterprise guarantee

For enterprise clients: if agreed-upon targets are not met and all sessions have been attended, the program will be extended at no additional cost.

5. Intellectual property

5.1 Ownership

All content on this website and within our programs, including text, graphics, logos, images, course materials, assessments, and software, is the exclusive property of Achivr Educational Technologies OÜ or its licensors. The following are trademarks of Achivr Educational Technologies OÜ:

5.2 Permitted use

You may:

  • View and access content for personal, non-commercial use
  • Print individual pages for personal reference
  • Share links to our publicly available content

5.3 Prohibited use

You may not:

  • Reproduce, distribute, or publicly display our content without written permission
  • Modify, adapt, or create derivative works from our content
  • Reverse-engineer any software or assessment tools
  • Use our trademarks without prior written authorization
  • Scrape, crawl, or use automated tools to extract content from our website
  • Share BASTION reports or assessment results outside of authorized recipients

6. Diagnostic assessment terms

By completing our Business English Diagnostic, you acknowledge that:

  • Your responses may be analyzed using AI-powered tools to generate proficiency assessments
  • Results are indicative of your current level and do not constitute a certified qualification
  • We may use anonymized, aggregated assessment data for research and service improvement
  • For enterprise clients, assessment results may be shared with authorized company representatives as agreed in the program terms

7. User conduct

When using our website and services, you agree not to:

  • Provide false or misleading information
  • Use our services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Disrupt or interfere with the operation of our website
  • Use automated tools, bots, or scripts to access or interact with our services without authorization

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to our services shall not exceed the greater of:

  • The fees you paid to us in the 12 months preceding the claim, or
  • EUR 100

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the availability, accuracy, or fitness for a particular purpose of our services.

Nothing in these terms excludes or limits our liability for fraud, willful misconduct, or any other liability that cannot be excluded under applicable law.

Our website may contain links to third-party websites and services. We are not responsible for the content, privacy practices, or availability of these external sites.

Our services integrate with the following third-party platforms:

  • Tally: form collection and diagnostic assessments
  • iClosed: consultation and strategy call booking
  • Stripe: payment processing
  • Teachworks: client scheduling and session management
  • Kit (ConvertKit): email communications

Your use of these third-party services is subject to their respective terms and privacy policies.

10. Governing law and jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from these terms shall be submitted to the courts of Tallinn, Estonia.

If you are a consumer in the European Union, nothing in these terms affects your rights under mandatory consumer protection laws of your country of residence.

The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

11. Changes to these terms

We reserve the right to modify these Terms and Conditions at any time. We will provide at least 30 days' notice of any material changes by updating the "Last updated" date and, where appropriate, notifying you via email.

Your continued use of our services after the effective date of changes constitutes acceptance of the updated terms.

12. Severability

If any provision of these terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall continue in full force and effect.

13. Entire agreement

These Terms and Conditions, together with our Privacy Policy and any applicable program agreements, constitute the entire agreement between you and Achivr Educational Technologies OÜ regarding the use of our website and services.
